Kripalu Terms and Conditions of Sale

THESE TERMS OF SALE (“TERMS”) CONTAIN VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. THESE TERMS APPLY ONLY TO THE SERVICES IDENTIFIED BELOW (THE “SERVICE” OR “PROGRAM”). KRIPALU MAY MAKE AVAILABLE OTHER SERVICES (“THIRD-PARTY SERVICES”) ADMINISTERED BY A THIRD-PARTY (“THIRD-PARTY SERVICE PROVIDER”). YOUR USE AND ACCESS OF THIRD-PARTY SERVICES ARE GOVERNED BY THE THIRD-PARTY SERVICE PROVIDER’S PRIVACY POLICY AND TERMS OF SERVICE.

These Terms incorporate by reference the Kripalu Website Terms of Use as well as the Kripalu Privacy Policy. In the case of a conflict between these Terms and the Kripalu Website Terms of Use, these Terms shall supersede. These Terms, the Kripalu Website Terms of Use and the Kripalu Privacy Policy constitute the Agreement for your use of Service being purchased, which is made available by Kripalu Center for Yoga & Health (referred to as Kripalu, us, we, or our as the context may require). The Agreement is subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms will be in effect as of the “Last Updated Date” and accessible via the Kripalu Terms and Conditions of Sale. The Kripalu Website Terms of Use as well as the Kripalu Privacy Policy are also subject to change and you are responsible for reviewing those terms periodically. Your continued use of the Service will constitute your acceptance of and agreement to all such changes.

  1. ORDER ACCEPTANCE/CONFIRMATION. You agree that your order is an offer to buy under the Agreement. Kripalu reserves the right to accept or reject orders in its sole discretion.
     
  2. PRICING/PAYMENT
    1. US Dollars.  All prices are in US dollars.
       
    2. Prices Subject to Change.  All posted or advertised prices posted are subject to change without notice. The price charged for the Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your order total (as applicable) and will be itemized in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer made by us and we reserve the right to cancel any orders arising from such errors.
       
    3. Payment Terms; Method.  Terms of payment are within our sole discretion and are currently processed via Shift4. Payment processing is governed by the Shift4 terms and privacy policies, available at www.Shift4.com. Full payment is due at time of registration and can be made with Visa, MasterCard, American Express, or Discover. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any. 
       
    4. All registrations and bookings are subject to Kripalu’s cancellation policies listed below. PLEASE REVIEW THE SPECIFIC CANCELLATION AND REFUND POLICIES FOR EACH SERVICE:
      1. KRIPALU RESERVES THE RIGHT TO CANCEL ANY SERVICE OR PROGRAM AT ANY TIME. IN THIS EVENT, YOU WILL BE GIVEN A COMPLETE REFUND OR CREDIT (AT OUR DISCRETION). A REFUND WILL BE CREDITED BACK TO THE ORIGINAL PAYMENT METHOD OR CARD; AND A CREDIT WILL BE APPLIED TO YOUR KRIPALU ACCOUNT AND WILL REMAIN VALID FOR A PERIOD OF 12 MONTHS.
         
      2. ONSITE and ONLINE Programs (including R&R and RISE). Payments made will be refunded in full (less a $50 processing fee) if canceled 15 or more days prior to the Program or Service start date. If you cancel between 14 days and one day in advance, a nonrefundable credit to your Kripalu account (less a $50 processing fee) will be held for one year from the date of issue. No credit or refund is available if you cancel on your arrival day, do not show up, leave a program, event, or accommodation early and if you arrive on campus with symptoms of active infection. If you test positive for Covid-19 during your retreat you must leave Kripalu. If you are required to leave due to a positive Covid-19 test, you will be eligible for a credit on account valid for 1 year from date of issue for the portion missed due to early departure. 
         
      3. ONSITE and ONLINE Kripalu Schools.
        Refunds for On Campus and Online Trainings*: Refunds (less a $50 processing fee) will be given according to the following schedule: for cancelations up to the start of the program, 100 percent of monies paid will be refunded. From program start and up to completion of 25 percent of the program, 75 percent of tuition will be credited to your Kripalu account. Up to completion of 50 percent of the program, 50 percent of program tuition will be credited. Up to completion of 75 percent of the program, 25 percent of the program tuition will be credited. A credit for any unused days related to on campus accommodations (or commuter fee) and meals will also be given. All credits on account will be valid for 1 year from date of issue. No other refunds or credits are available. Kripalu’s standard cancellation policy applies to all other charges such as Healing Arts booking. Please note: cancellation of program involvement also includes dismissal of a student by Kripalu administration due to violations of student agreements and/or guest center policy.         Notes on Terms: For programs offered with multiple on campus and/or online sessions with nonprogram days in between course days, credits on account are based on full program length—meaning total number of days in which the program holds sessions associated with the posted tuition. (E.g. a 200-Hour Yoga Teacher training offered in two 12-day on campus sessions will have one tuition that covers 24 days, and early departure after the first 12-day session would result in a 50% tuition credit plus an additional credit for any unused accommodations/commuter fee and meal charges for program days remaining.) For other certifications with multiple modules, program cost is determined based on one module at a time. Program start date refers to the start of each module.
        Refunds for Kripalu Schools Scholarship Recipients: Refunds will be given according to the following schedule: for cancellations up to the start of the program, 100 percent of monies paid will be refunded. From program start and up to completion of 25 percent of the program, 50 percent of the monies paid will be credited to your Kripalu account. Up to completion of 50 percent of the program, 25 percent of the monies paid will be credited. All credits on account will be valid for 1 year from date of issue. No other refunds or credits are available, including any additional consideration for accommodations/commuter fee or meals. Kripalu’s standard cancellation policy applies to all other charges such as Healing Arts booking. Please note: cancellation of program involvement also includes dismissal of a student by Kripalu administration due to violations of student agreements and/or guest center policy.
        *If you are an international student traveling to Kripalu for a training and you are unable to obtain a visa to allow you entrance into the United States, we will refund in full all monies paid toward tuition and housing, including the $50 processing fee. Application fees are non-refundable.  
         
      4. ONSITE and ONLINE Healing Arts. Payment is taken at the time of booking and is fully refundable for rescheduling and cancellations up to 24 hours before your service. Rescheduling or canceling treatments within 24 hours will be refunded at 50% of the treatment price as credit on account. No shows will be charged 100% of the cost of treatment. If you need to leave your Day or Overnight stay early due to illness, Kripalu will waive the cancellation fee for Healing Arts treatments canceled within 24 hours. 
         
      5. ONLINE Technical Issues. Users are entirely responsible for having working internet, computers and other technology necessary to connect to the Kripalu offering at the date and time the Program is offered. However, if technical issues caused by Kripalu or its third-party providers result in cancellation or outages/content loss, then Kripalu in its sole and exclusive determination may offer the following in place of a refund or credit:
        • Kripalu will make up the Program sessions and/or provide a recording to those who were prevented from attending;
        • In cases where the Program is interrupted, and the lost content/presentation is material to the Program, Kripalu will facilitate the delivery of the missing content/materials as determined by Kripalu in collaboration with the presenter, within a reasonable period of time following the original Program delivery date(s).
           
  3. COVID PROTOCOLS: You agree to follow all current COVID Protocols put in place by Kripalu to protect the safety of the community and acknowledge that if you do not follow the protocols, you may be asked to end your stay and the forfeiture of any amounts paid. Kripalu COVID Protocols are subject to change and you are responsible for reviewing them before and remaining current on any changes during your stay.
     
  4. RECORDINGS.  Kripalu reserves the right to record in any manner or medium, certain programs and sessions (not including Healing Arts sessions), and by participating in our programs, you agree that your voice, image and likeness may be recorded (audio, video, etc.). The recordings shall constitute Kripalu intellectual property, and may be used, sold, licensed, broadcast, and otherwise commercially exploited as determined by Kripalu in its sole and reasonable discretion. Excluding those participants in Healing Arts sessions, you hereby grant to Kripalu and its affiliates and assigns the right and permission to use in perpetuity, your name, likeness, image, voice, recorded voice, appearance, biographical information, statements, performance and/or testimonial(s) (Appearance) in any manner and in any media, now known or later developed, throughout the world, at any time, for Kripalu’s business purposes, without review, permission or compensation of any amount or kind whatsoever. In addition, except for participants in our Healing Arts sessions, our third-party providers—such as Zoom—may also record programs for their or our archival purposes. You shall not hold Kripalu responsible for any liability resulting from the lawful use of your Appearance in accordance with the terms of this section, or the recording activities described hereunder.
     
  5. FORCE MAJEURE: Neither Kripalu nor any of its third-party providers shall be liable for any failure or delay in the performance of its obligations under the Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation, acts of God; natural disasters; wars; civil or military disturbances; sabotage; strikes; epidemics or pandemics; riots; power failures; computer failure; loss or malfunction of utility, transportation, computer (hardware or software) or telephone communication service; accidents; labor disputes, acts of civil or military authority; governmental actions; or inability to obtain labor, material, equipment or transportation. The foregoing notwithstanding, technical issues experienced or caused by Kripalu and/or its third-party providers are addressed in Section 2 above.
     
  6. LIMITATION OF LIABILITY: To the greatest extent permitted by law, in no event shall Kripalu or its trustees, employees, agents, partners, suppliers or content providers be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the program (i) for any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising), (ii) for any bugs, viruses, Trojan horses or the like (regardless of the source of origination) or (iii) for any direct damages in excess (in the aggregate) of the greater of (a) fees paid to us for the particular program or (b) $100.00. These limitations will only apply to the extent permitted by law and do not apply to death or personal injury resulting from our acts or omissions or to liability resulting from our gross negligence or willful misconduct.
